These Terms & Conditions (“Terms”) govern your use of the Canadian Utility Savings & Support (“CUS&S”, “we”, “us” or “our”) website and homeowner support services. By using the website or submitting a request, you agree to these Terms. If you do not agree, do not submit personal information or use our services.
1. Independent non-profit service
CUS&S is an independent non-profit support organization. We are not the Government of Canada, a provincial or territorial government, a municipality, a Crown corporation, a utility, a program administrator, a regulator, an energy advisor or a contractor. We do not speak for, administer or endorse any government or utility program. Government and utility names and marks belong to their respective owners.
2. Informational assistance only
Our service helps homeowners locate public information, understand possible program requirements and, if requested, connect with independent service providers. Information on this website is general and is not legal, tax, financial, engineering or building-code advice. You must confirm all requirements directly with the official program administrator and obtain appropriate professional advice before making decisions.
3. No grant or savings guarantee
Programs, budgets, eligibility rules, deadlines, incentive amounts and approved equipment can change, close or vary by location without notice. A postal code result, assessment, referral or conversation does not establish eligibility, reserve funding or constitute program approval. We do not guarantee that you will receive a grant, rebate, loan, tax credit, utility incentive, invoice deduction, cheque or any level of energy or cost savings. Do not begin work or purchase equipment until the applicable administrator confirms whether pre-registration, an energy assessment, approved equipment, quotes or written approval are required.
4. Independent contractors
Any contractor, energy advisor or other provider introduced through our service is an independent third party and is not our employee, agent, partner or representative. A referral is not an endorsement or warranty. Although we may review evidence of licensing, trade credentials, liability insurance, workers’ compensation standing and program-related qualifications, credentials can expire or change. You are responsible for independently verifying current credentials, references, permits, equipment eligibility, pricing, scope, warranties, timelines and insurance before hiring anyone.
Your contract for assessments, products or work is directly with the third-party provider. CUS&S is not a party to that contract, does not direct the work and is not responsible for a contractor’s acts, omissions, statements, workmanship, safety, delays, charges, warranties or compliance. Payment terms, cancellation rights and dispute procedures must be stated in your written contractor agreement.
5. Your responsibilities
- Provide accurate, current and complete information;
- Use the service only for a lawful request concerning a property you own, occupy or are authorized to discuss;
- Review official program documents and written contractor terms;
- Obtain required permits, approvals and professional advice; and
- Protect any reference numbers or communications relating to your request.
6. Acceptable use
You may not interfere with the website, bypass security or rate limits, submit malicious code, impersonate another person, collect information about others, use automated means to overload the service or use the content for unlawful, fraudulent or misleading purposes. We may suspend access or decline a request where reasonably necessary to protect people, systems or legal rights.
7. Intellectual property
The website’s original text, layout, graphics, organization name and related materials are owned by or licensed to CUS&S and are protected by applicable intellectual-property laws. You may print or save a reasonable copy for your personal, non-commercial use. You may not reproduce, modify, distribute, sell, scrape or create derivative works from our materials without written permission, except as permitted by law. ENERGY STAR and government program names and marks remain the property of their respective owners.
8. Third-party websites
Links to government, utility, contractor or other websites are provided for convenience. We do not control their availability, accuracy, security, content or practices. A link does not imply affiliation or endorsement. Verify that you are using an official program website before providing information or making a payment.
9. Disclaimers and limitation of liability
The website and support services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not warrant uninterrupted access, error-free content, program availability, contractor performance, equipment performance or a particular result. To the fullest extent permitted by applicable law, CUS&S and its directors, officers, employees and volunteers will not be liable for indirect, incidental, special, consequential or punitive damages, loss of savings, loss of data, property damage, delay or costs arising from use of the service, reliance on information, program denial or dealings with a third party. Nothing in these Terms excludes liability that cannot lawfully be excluded, or limits rights available under applicable consumer-protection law.
10. Privacy
Our Privacy Policy forms part of these Terms and explains how we handle personal information, including cross-border processing and contractor disclosures.
11. Changes and availability
We may update website content, these Terms or the service to reflect legal, program or operational changes. The effective date identifies the current version. Continued use after a change means you accept the revised Terms. We may correct errors or discontinue all or part of the service without guaranteeing advance notice.
12. Governing law and disputes
These Terms are governed by the laws of the Canadian province or territory in which the homeowner ordinarily resides and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts in that province or territory will have non-exclusive jurisdiction, subject to mandatory consumer-protection rights and any right to bring a claim in another competent forum.
13. General
If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. These Terms and the Privacy Policy form the entire agreement concerning use of the website and support service, separate from any agreement you enter with a contractor or program administrator.
